Terms of Agreement
*The Laundry Basket is provided subject to the customer’s acceptance and compliance with the terms and conditions set forth below. Please read the following agreement, the use of The Laundry Basket indicates your agreement to be bound by the terms and conditions listed below.
Drop off Schedule: Pick-ups and drop-offs will occur Monday, Tuesday, Wednesday, and Friday between the hours of 6pm and 8pm and Saturday and Sunday at pre scheduled times. The Laundry Basket pick up and drop off will not take place on selected holidays. The Laundry Basket reserves the right to determine the pick-up and drop-off times at its own discretion and reserves the right to reschedule such times upon prior notice to Customer. Pick Up and Delivery, Procedure and Terms: The Laundry Basket will provide Customer with 1 identification claim ticket per bag/basket. Customer agrees not to include (i) non-washable items in the laundry bag/basket(s), (ii) items that are labeled for dry-cleaning only (iii) any other items not meant for laundering or dry-cleaning in, or attached to any of the items to be cleaned or inside any of the bag/basket(s). Customer is responsible for any and all damage caused by any items left in its clothing or in the bags/basket(s) that cause any damage to the clothing, cleaning machines, or anything else. Missed Pick Up: If a pickup is missed the Customer will be charged $5 at the discretion of The Laundry Basket. Payment: We accept cash only at this time. Payment is due at time of drop off. Inventory Sheets: Inventory sheets for each service will be available upon request, at drop off, or online at https://www.facebook.com/pages/The-Laundry-Basket-Springtown/1382453248741883 . Customer hereby states that all information provided on the inventory sheets is accurate and if no inventory sheet is provided agrees that The Laundry Basket is not responsible for the items in the bag/basket(s) . The Laundry Basket is not responsible for any items not listed on the inventory sheets. Customer agrees to complete inventory sheets for all items inside the bag/basket(s). If any items are left without an inventory sheet, The Laundry Basket reserves the right but is not obligated to complete one, based on the items inside the bag, without notice to the customer. If there is a discrepancy between what is listed on any inventory sheet and the actual items left in the bag, The Laundry Basket reserves the right to change the inventory sheet and based on a careful examination, make the final determination about the actual contents of the bag without notice to Customer. Customer consents to such changes. The Laundry Basket does not consent to the accuracy of any inventory sheet filled in by Customer. Garment Care and Missing or Damaged Goods: The Laundry Basket will use reasonable efforts to try to ensure that its cleaning service maintains a high quality service. The Laundry Basket accepts no liability for damage due to normal cleaning of items without care instructions and accepts no liability for items treated in accordance with the care labels or other instructions provided. The Laundry Basket accepts no liability for "special care" items that require special attention to be cleaned or that do not have care instructions. The Laundry Basket is not responsible for clothing bleeding, shrinking, or otherwise changing that results from normal wash. Precautions will be taken to alleviate these problems if possible. The Laundry Basket reserves the right to refuse cleaning any garment The Laundry Basket does not guarantee removal of all stains. The Laundry Basket is not responsible for loss of or damage to any personal or non-cleanable items left in the clothing or bags such as money, jewelry, or anything else. Customer agrees not to leave such items in its clothing or in the delivery bag/basket(s). Although The Laundry Basket is not liable for damage to or loss of clothing due the fault of the third party cleaners or service providers, if The Laundry Basket at its sole discretion desires to, The Laundry Basket may compensate Customer for lost or damaged clothing in an amount to be determined by The Laundry Basket. Customer must notify The Laundry Basket within 48 hours of receipt of a delivery of any lost or damaged items from that particular delivery, failure to do so constitutes waiver of a claim for any lost or damaged items from that delivery. Service Providers/Disclaimer of Certain Liabilities: The Laundry Basket or its associates will deliver Customer's items to and from a laundering service of The Laundry Basket’s choice. The Laundry Basket reserves the right to utilize any outsourcer, vendor, or outside service provider, for any service, at its sole discretion without notice to Customer. The Laundry Basket is not responsible and will not be held liable for any damage or loss due to the acts or omissions of its vendors, third party outsourcers, or service providers. Disclaimer: The Laundry Basket's liability under this agreement shall be limited to general money damages in an amount not to exceed the charges for the term of service paid by Customer in the term under which the damages are alleged to have occurred. This liability shall be the extent of The Laundry Basket's liability regardless of the form in which any legal or equitable action may be brought and the foregoing shall constitute Customers exclusive remedy. In no event will The Laundry Basket be held liable or be responsible for any consequential, accidental, special, indirect, incidental, or punitive loss or damages whether or not The Laundry Basket knew or should have known of the likelihood of any loss or damages. The Laundry Basket disclaims all warranties, express or implied with respect to the services rendered under this agreement. All sales are final. All payments are non-refundable. Entire Agreement/Choice of Law: This agreement and any documents referred to herein constitute the complete, exclusive, and entire agreement between the parties, may not be modified except in writing signed by both parties, and shall be governed by the state in which it operates.
